Malad City Council was held October 11, 2000 at City Hall. Mayor Spence Horlsey called the meeting to order with council members Larry Thomas, Ton Jenkins, Ruth Zivkovic, and Joe Thomas present. Also in attendance were Treasurer Terrill Schwartz, Superintendent Sid Hess, Clerk Susan Wittman, Attorney Steve Brooks, JaLynn Weeks, Bonnie Bott, Red Monte Thomas, Sharee Blaisdell, Josh Blaisdell, and Heidi Brooks.

Tom moved to accept September 13, 2000 minutes as written. Ruth seconded the motion. The motion carried.

Heidi Brooks, representative Parent Teacher Organization, appraised the council of the activities planed for red ribbon week October 23-27. Heidi asked for the council support on October 25, a free finger printing clinic will be held from 4:00 p.m. - 6:00 p.m. At 6:30 p.m. Elaine Runyan-Simmons will be the guest speaker talking about child abductions. Elaines daughter Rachel was a victim of a stranger abduction in 1982. Sheriff Jeff Semrad and a FBI agent will also speak.

JaLynn Weeks reported to the council that she attended the Youth at Risk meeting at Ruth's request. She said that the meeting was very good. JaLynn has arranged for a band from Tremonton to put on a concert November 11 to raise money for the skate park. JaLynn also told the council that the Start Smart Parent Group will be at the Halloween Carnival with a fund raising booth. JaLynn invited the council to the ribbon cutting ceremony for the new play ground equipment at the city park. It will be held October 28 at 11:00 a.m. JaLynn has obtained door prizes from local businesses. JaLynn told the council that there have been concerns about moving the baseball diamond to make room for the playground equipment. Sid and JaLynn have measured and there will be 200 feet for the ball diamond. JaLynn has been attending the gymnastic classes. The city will not have to buy mirrors. They have been donated. She has found 2 used spring boards from Rocky Mountain Middle School for $25.00 a piece. The council authorized her to purchase them.

Red Monte Thomas informed the council that the fire department has put Todd Jones on as a fireman. They will be ordering new gear for him. The suit costs $900.00. They plan on getting 3 new suits a year. Red Monte told the council that the 1977 truck is wore out. He is working on getting a truck like the last one.

Spence told the council that he has talked to Attorney Steve Brooks about letters to landowners who properties need to be cleaned up. Steve is waiting for a condemnation letter from the building inspector before he proceeds with a letter to Dale Price about the Grit Shop. Spence also said that a letter needs to be sent to Roger Deal about his manufacturing with in a R-2 zoned area. Neighbors are complaining.

Tom also said that it has been brought to his attention from an article in the Idaho Enterprise that Wes Duggan's father is living in his motor home behind Wes's home. Tom said that this shouldn't be allowed.

The council agreed to met October 18 at 5:30 to survey the town of areas that need to be cleaned up.

Mayor Horlsey told the council that a clear hook up policy needs to be adopted for water and sewer. Spence said the council needs to decide if the city should participate in the cost or leave it like it is and the landowner is responsible for the cost to hook in. Spence also said that the city can consider helping with trenching or waiving the hook-up fee.

Ruth asked if it would be possible for the city to expand the sewer system, one area per year.

Joe pointed out that most sewer systems were paid by the landowners by LID's. He felt that the city is not in a financial position to put the lines in. If you do it for one, you do it for all residents.

Larry felt the only fair way is to stay with the current policy.

Tom felt that current sewer and water lines need to be updated.

Terrill told the council the cost of upgrading the systems would not go through the general fund, it would be the enterprise fund. The water and sewer fees would need to be looked at.

Spence said that he has inquired to SICOG and the only grant money available for sewers is for sewer studys.

This item was continued until later in the meeting when Attorney Brooks arrived.

Spence told the council that he attended the Senior Citizen dinner last week. Spence commented on want a great meal they serve. They are requesting $750.00 in more funding for the dinners. The costs of home delivery has increased.

Ruth moved to give $750.00 to Malad Senior Citizens for home delivery. Larry seconded the motion. The motion carried.

Spence also stated that SICOG has obtained a grant to provide a health mobile to the Southeast Idaho Counties Senior Citizens Centers.

Superintendent Sid Hess reported to the council the water sample of the depot well has not come back yet. The pump is estimated at 800 gallons free flow. Sid told that he is concerned about the fuel bulk plants being so close to the well. DEQ will probably have a problem with that. DEQ is also considering having the city shut down the MVI well because of ground water from the creek.

Sid submitted bids for fencing on Bush Ave. and the city park. Hess Lumber for materials only $4,192.00. T&T Fencing (Tracy Marbel) $4,300 including materials and installation. Sid felt that the council should go with T&T Fencing since they will install the fence.

Larry moved to accept T&T Fencing bid of $4,300 to install a fence at the city park along the Bush Ave. homes.

Sid told the council that Marty Hill has a 10 wheeler dump truck for sell for $13,000. The council would like more information about the truck before a decision is made.

Sid reported the crew is working on installing the playground equipment at the park. Sid said Blake Love will check out the grate in front of Scotts Land and Title. They have installed the no truck signs on 155 South.

Larry said that he has had many complaints about not having a stop sign at 300 North and Bannock St. He has looked at this intersection and feels a stop is needed.

Larry moved to install a stop sign at the intersection of 300 North and Bannock St. Tom seconded the motion. The motion carried.

Joe moved Attorney Brooks write a policy that would reaffirm the past and present policy of the city not participating in sewer hook ups. The city will pay the costs difference from a 4" line to a 6" line. Larry seconded the motion. The motion carried.

Steve introduced Ordinance No. 440

Larry moved to adopt Ordinance No. 440 an ordinance to close and abandon an unused portion of Fifth North Street in the City of Malad, Idaho, located South of the David Colton home at 500 North 500 West in Malad City, Idaho; providing an issuance of a quitclaim deed to the abutting land owner providing that the abutting owner pay the cost of advertising for this ordinance; and providing and effective date. Ruth seconded the motion. The motion carried.

Spence said that Becky Clark called about the right of way North of her home. This is the right of way that Randy Jones talked to the council about in September. She said that she was told that it would go back to her. She said that Vernon Jones was the one who had her property surveyed.

Treasurer Terrill Schwartz gave the financial report.

Tom moved to pay the bills. Joe seconded the motion. The motion carried.

The council went into executive session.
