Malad City Council was held June 9, 1999 at 6:00 p.m. at City Hall. Mayor Spence Horsley presided with council members Larry Thomas, Sandra Hess, and Ruth Zivkovic present. Also in attendance were Treasurer Terrill Schwartz, Superintendent Sid Hess, Clerk Susan Wittman, Attorney Steve Brooks, Building Inspector Robert Brennan, Sheriff Jeff Semrad, Engineer Wayne Shepherd, Bonnie Bott, Dee J. Williams, Debbie Howard and Ione LaTour.
Mayor Horsley gave the invocation and Clerk Susan Wittman led the pledge of allegiance.
Dee J. Williams ,Director Malad Senior Citizen Center, presented a request of $7,000 for funding for the next city budget year. He is asking for $500.00 more than last year. He is going to give the employees a raise. The center served 8,000 meals and home delivered 3,000 last year. Dee J. told the council that the roof is leaking over the kitchen area. Ferris Hess has patched it and he has submitted a grant to the Idaho Community Foundation for a new roof.
The council accepted the request for funding from the Senior Citizen Center and it will be put in the budget.
Oneida County is holding a hearing to abandon certain county roads on Monday June 14 at 11:00 a.m.. One road the county is considering abandoning is the David Nielsen lane. The city has a right of way on this road for access to the old culinary reservoir. Sid said they do not use this road any more because the bridge is washed away over the creek but some day if the Christophersen's don't allow them through their property the city may need to use this road of Nielsen's. Attorney Steve Brooks was instructed to check to make sure the city does have a written right of way through David Nielsen road. Sid will talk to John Christophersen to see if the city can obtain a right of way through their property to check the reservoir.
Mayor Horsley said that he has been contacted by Barbara Thompson from the Post Office and she said that there are problem with some addresses on city streets. Susan will get a copy of the plats from the County Assessor to mark the maps to get this fixed.
Spence reported that Sid and himself went on the weed tour during the city portion of the tour. Rauhn Panting said that he has a source that will come in and help take care of the weeds problem for residents.
Larry reported that the trenching was finished today at 4:00 by LeRoy Rose. The council asked Sid to get the sprinkling system finished. Larry has been trying to get in touch with Mr. Marble about what is going on.
Treasurer Terrill Schwartz present the lease purchase financing for the back-hoe. Terrill checked with U.S. Bank, Ireland Bank and Western States for financing. Western States was the best deal and they have their financing through 1st Security Bank.
Sandra moved to approve the lease purchase agreement with 1st Security Bank for $59,392.00 for new caterpillar Model 416C tractor-loader-backhoe. Larry seconded the motion. The motion carried.
Robert has 2 bids for the roofing of the City Hall building. Modern Roofing bid $6795 for the entire roof. This is for a hot patch. Briggs Roofing bid $6600 for a hot patch and $9900 for a membrane roof. Robert will check about the guarantee of the membrane roof.
Larry moved to authorize Mayor Horsley to make a decision after finding out about the guarantee of the roofs. Sandra seconded the motion. The motion carried.
Sid reported that he has been having the summer help cut weeds. The weed mower is broke down. They are waiting for parts. A grass sweeper was purchased from Evans Co-op.
Sandra asked for approval to add 300 West from 700 North to the City line to the list of roads to be oiled this summer. Sid said that he will get started next week on 100 North. Sid also told the council that holes appeared in the sewer lagoons. He called DEQ and Engineer Wayne Shepherd and they came and looked at them. The crew has the holes sealed and they will go in later and do more repairs. The holes are caused by foxes.
Larry moved to oil the road on 300 West from 700 North to the city limits. Ruth seconded the motion. The motion carried.
Debbie Howard and Ione LaTour meet with the council about the storm water problem on their street. When it rains the water jumps the curb by Leland Wards home and runs down the sidewalk. This causes their lawns and flower beds to wash away.The council told them that they will discuss the situation with the city engineer.
Ione also asked the council if the school sign on her curb be straightened. It is propped up with a rock. Sid said they will fix this.
Robert Brennan asked if the city would make Welton Ward clean up his rental property next to him. Susan will call Welton.
The council went into executive session at the request of Sheriff Jeff Semrad.
Spence told the council that he has request Attorney Steve Brooks to give a legal opinion on cleaning up lots in Malad.
Ruth told the council that the swimming pool is still be trashed with roofing from the Eagles building.
Ruth reported that Deon Hanson complained about her neighbor David Jones because he has animals right next to her home. Attorney Brooks will write a letter to Mr. Jones stating that he can't have animals that close to a home.
Ruth also said that she has not heard about her skate park and green belt grant. She also brought before the council the idea to have a 1st night celebration on New Years. It was suggested that the Chamber will be doing some thing.
Susan told the council that she will not be doing the float this year. She told the council that they are welcome to do it.
Larry mentioned that the stop sign has not been put back up at Paul Semrads.
Steve told the council that there will be a motorcycle rodeo at the fairgrounds. They have asked that they can block off N. Main street that morning to show off their cycles. Steve was told to contact the Chamber of Commerce.
Engineer Wayne Shepherd presented to the council a new set of plans for the 4 Points intersection. He has sent a letter to proceed to Rupp Trucking for this project. He called them since it has been almost a year. They are still interested in the project but are busy now. He will probably sub out the back filling of the project to a local contractor.
The council asked Wayne to look at the storm drainage problem on 300 West. Sandra also asked Wayne if he could get a grid of the city to help with the addresses.
Treasurer Terrill Schwartz gave his financial report.
Larry moved to approve May 12, 1999 minutes as written. Ruth seconded the motion. The motion carried.
Sandra moved to pay the bills. Larry seconded the motion. The motion carried.
