Malad City Council was held January 12, 2000 at City Hall. Mayor Spence Horsley presided with council member Larry Thomas, Sandra Hess, Ruth Zivkovic and Jared Crowther present. Also in attendance were Treasurer Terrill Schwartz, Clerk Susan Wittman, Attorney Stevin Brooks, Engineer Wayne Shepherd, Building Inspector Robert Brennan, Debbie Horsley, Rhonda Crowther, Doug Crowther, Eric Crowther, Shannon Crowther, Bill & Ruth Thomas, Sandra Thomas, Bonnie Bott.

Councilman Larry Thomas offered the invocation and Susan Wittman led the pledge of allegiance.

Jared Crowther moved to approve December 8 minutes with one correction. Page 2 paragraph 10, should be card board boxes not carbon boxes. Sandra seconded the motion. The motion carried.

Spence presented plaques to out going council members Sandra Hess and Jared Crowther and thanked them for their years of service to Malad City.

Clerk Susan Wittman gave the oath of office to newly elected council members Tom Jenkins and Joseph Thomas.

Mayor Horsley welcomed the new members and gave the following assignments Larry Thomas - Parks, Recreation and Water Tom Jenkins - Planning & Zoning, Roads and Sewer Ruth Zivkovic - Grants, Youth at Risk, SICOG Joe Thomas - Animals, Garbage, Emergency Planning Joe will be the Chaplin and Spence will over see the cemetery.

Joe moved to that Larry Thomas be the president of the council. Ruth seconded the motion. The motion carried.

There has been interest in the community to do a time capsule since this is a new century. The County and School will be contacted to participate.

Attorney Brooks presented a dog ordinance for the council to review. He has consolidated all the dog ordinances other then the kennel ordinance. Steve questioned the fees he felt they are low. Mayor Horsley said that he felt that they should stay the same. The council was in agreement that the dog citations will be ongoing instead of starting over each year.

Steve also told the council that he is ready to hold the annexation hearing for the county residents on 100 West that have city water services.

Tom moved to publish and give notice to the county residents on 100 West that will be affected by annexation. The hearing date will be February 9, 2000. Ruth seconded the motion. The motion carried.

Attorney Brooks presented Ordinance No. 436.

Ruth moved to suspend the 1st and 2nd reading of Ordinance No. 436. Joe seconded the motion. The motion carried.

Larry moved to adopt Ordinance No. 436 and ordinance annexing a parcel of land located contiguous and adjacent to the City of Malad, Oneida County, State of Idaho, hereinafter described and located in Section 21, Township 12 South, Range 36 East, Boise Meridian and declaring an effecting date. Ruth seconded the motion. Roll was called. Ayes: Larry, Tom, Ruth and Joe. Nays: none. The motion carried.

Steve will prepare a notice for publication of a public hearing to change the variance procedure as stated in the zoning ordinance.

The council set a workshop for January 19 to discuss the water & sewer lines in the city and how to assist residents that have land in the city but services are not available.

Building Inspector Robert Brennan explained the 1997 uniform building code and the exception and additions. The council okayed having the ordinance prepared for adoption. The fee schedule will stay as it is currently.

Engineer Wayne Shepherd asked the council to look at 4-Points intersection when they drive through it so the next phase can be decided. He is making changes to the culinary water spring box design for DEQ. Wayne reported that no chloroform was found in the test wells at the sewer lagoons. Ruth asked Wayne about a grate for the drain box on 4-Points. Wayne will get this done.

Treasurer Terrill Schwartz gave his financial report.

Larry moved to pay the bills. Joe seconded the motion. The motion carried.
