Malad City Council was held April 12, 2000 at City Hall. Mayor Spence Horsley presided with council members Larry Thomas, Tom Jenkins, Joe Thomas and Ruth Zivkovic present. Also in attendance were Treasurer Terrill Schwartz, Superintendent Sid Hess, Clerk Susan Wittman, Attorney Stevin Brooks, Sheriff Jeff Semrad, Engineer Wayne Shepherd, Mary Matthews, Lucile Harrison, Rhonda Neal, Rita Martin, Ron Smith, Craig Hagler, Gene Caldwell, Shirlee Blaisdell, Jack Harwell, Dale Reese, Bob Crowther, Jeff Crowther.

Tom moved to approve March 8 and March 10 minutes as written. The motion carried.

Cemetery committee members Mary Matthews and Lucile Harrison informed the council that Rhonda Neal and Brent Winward are new members of their committee.

Joe moved to accept Rhonda Neal and Brent Winward as new members of the cemetery committee.

Rhonda explained to the council that they would like to put a railing around the platform at the cemetery. They have also received a bid for decorative curbing from Chad Blechert.

Chamber President Rita Martin invited the council to the annual classic car show on May 6 and also asked the council to participate with Mayor Horsley in the pie throwing contest. She asked permission to barricade North Main St. from Bannock to 100 North from 9:00 a.m. to 3:30 p.m. They also need a power source because Disc Jocky J.C. Hacket will be there. The council okayed this. Rita also told the council that the Chamber Sign on 50 South has been installed.

Coca Cola representatives Ron Smith and Craig Hagler presented an agreement for the 2 baseball scoreboards. The city is to purchase the cable to the scoreboards.

Joe moved authorizing Mayor Spence Horlsey to sign the contract with Coca Cola Co. for 2 scoreboards after Attorney Steve Brooks has reviewed the document. Tom seconded the motion. The motion carried.

Gene Caldwell and Shirlee Blaisdell told the council that something has to be done about the shingles on the Eagles Building. Health Dept. inspector Steve Bastian told the county that he will shut down the swimming pool if the shingles continue to get in it. Spence said that he understood that a adjoining property owner is trying to purchase the building. It was decided to purchase visquin and put chicken wire over the top on the roof. This needs to be done by May 1.

County Weed Supervisor Jack Harwell said that noxious weeds in the city needs to be taken care of before they get out of control. If anyone has a question about identifying weeds he is the contact. Jack would like a time table on how the city will deal with the weeds. A weed tour will be held again this year on June 22 at 9:00 a.m. starting at the County Extension Office. Jack said that they will not spray private property.

Thelma Evans, AFLAC insurance repsentative, explained the policies their company has to offer. Currently one city employee is insured.

Sheriff Jeff Semrad reported he has received a bid for pagers. They are $321.00 a piece. The current pagers the fire dept. and city crew have are very worn out. His dept has started to do the citizen surveys and has received three back. The resource officer meeting has been canceled due to the lack of support from the school district. Jeff explained the emergency building that is being proposed from the BLM. A meeting will be held Monday May 8 at 3:00 p.m. to discuss this with the county commissioners.

A public hearing for the zoning of the new proposed LDS Stake Center will be held April 19 at 7:00 p.m.

Ruth moved to approve the funding request of $1,000 to the Soil Conservation for the fiscal year July 2001. Tom seconded the motion. The motion carried.

The council discussed about allowing county residents to hook up to city water and sewer lines if the lines are currently there.

Tom moved to allow county residents to hook up to current water or sewer lines that are presently in front of there property. The residents also have to sign an annexation agreement. Larry seconded the motion. The motion carried.

Larry reported Centerville City accepted our bid for the baseball backstops.

In response to the request made last month about compensating the Planning & Zoning board, Mayor Horlsey

Engineer Wayne Shepherd reported he has talked to John J. Williams about the drainage problem in front of his home. Mr. Williams does not want the water deverted behind his home. Wayne has 3 options. 1 - put a drainage line in with a catch basin and run it around the corner on 300 West. Cost approximatley $6,000 to 8,000. 2- Change the curb. It needs to fall 18". 3 - combination new curb with slotted drain pipe about 200 feet. Cost $4,000 to 6,000. Wayne will get better costs and narrow down options. He will have the plans ready for 4-Points drainage. They are waiting for DEQ to approve one more test on the spring water. It has to be during spring run off.

Superintendent Sid Hess told the council that he needs to hire a garbage truck driver while Dean Hamilton recovers from a back injury. He has also hired 2 kids to work at the cemetery until Memorial Day. The crew has fixed all the sprinkling pipe that they know about. They have fixed water leaks and worked on repairing the park baseball backstop. They will put new chain link on it. Sid said that he will get prices for a propane heater for the cemetery.

Attorney Steve Brooks introduced Ordinance No. 439. This ordinance was passed last month but Steve has found a few mistakes.

Ruth moved to suspend the 1st and 2nd reading of Ordinance No. 439. Tom seconded the motion. The motion carried.

Larry moved to accept the changes to Ordinance No. 439. Ruth seconded the motion. The motion carried.

Steve told the council that after reviewing the zoning ordinance the only authority the planning and zoning has with the green belt is if it qualifies for a special use and it does not apply.

Tom & Steve attended a workshop on subdivisions that was put on by AIC.

Treasurer Terrill Schwartz gave the financial report.

Joe moved to pay the bills. Larry seconded the motion. The motion carried.
